Small claims is the best. If the entity is out of state it requires them to come here and it's very inexpensive to you. makes for a quick settlement of anything under $7500

I had an issue with payments recently, the network used every excuse possible. Either they are completely incompetent, having cash flow issues, or more likely both. After nearly two weeks I started to call around for a lawyer in their locality.

What I found is that you can hire a lawyer in the US to represent you by proxy, even if you are on the other side of the earth. This applies for small and large amounts. In most states, the delinquent party will be responsible for paying your legal fees. Other states impose penalties on non-paying employers. In Colorado for example, a non paying employer has to pay 3x the amount owed.

Luckily, they paid the day after I had contacted a few lawyers and gotten the above information.

My interpretation... Before doing business with a merchant or network, look to see where they're based.

so this is basically saying, that you need to file where they are at to prevent headaches & to be 100% sure you can collect. But if you want to try it, they just have to do alot of "business" in your state. or they had to actually travel to your state to conduct business. So it basically means - file int heir state???
